Health and Safety Terms and Conditions for The Bounce House
At The Bounce House, we prioritize the safety of all users and the condition of our equipment. To ensure that everyone enjoys a safe and fun experience, we have outlined the following health and safety terms and conditions for the hire of our inflatable bouncy castles and related equipment. By signing this Agreement, the Hirer acknowledges and agrees to the following:
1. Supervision and Safety Requirements
1.1 Supervision: The Hirer agrees that an adult over the age of 18 must supervise the inflatable equipment at all times during use.
1.2 Safe Usage: Only the maximum number of users specified for each inflatable (as listed on our website) should be allowed on the Equipment at any time. Overcrowding is dangerous and may result in injury or damage.
1.3 Running and Rough Play: It is strictly prohibited for anyone to run, jump recklessly, push, or collide with others while using the inflatable. Aggressive play or any behavior that may cause harm to others or damage the equipment is not allowed.
1.4 Inappropriate Items: The Hirer must ensure that no sharp objects, pets, food, drink, chewing gum, or substances like face paint, glitter, streamers, or silly string come into contact with the inflatable. These items can damage the equipment or cause injury.
1.5 Health Conditions: Individuals with back, neck, or other pre-existing health conditions should not use the equipment. The Hirer is responsible for ensuring all users are physically fit to use the inflatable.
2. Usage Restrictions
2.1 No Smoking or BBQ: Smoking or the use of BBQ equipment near the inflatable is strictly prohibited.
2.2 No Climbing or Hanging: Users must not climb, hang, or sit on the walls of the inflatable. This can cause serious injury and damage.
2.3 Equipment Movement: The Hirer agrees not to attempt to move the inflatable once it has been set up by The Bounce House. Moving the equipment can result in damage and injury.
2.4 Weather Considerations:
- Wind: If wind speed is 30 km/h or more the inflatable won’t be set up. If the wind increases throughout the duration of hiring and reaches 30k/m or more the inflatable must be deflated immediately and should not be used. The final decision of whether a castle is safe to be set up during a windy day is up to us. If we do not think the wind conditions are safe for the castle to be set up we will unfortunately have to cancel the booking and will supply you a full refund.
- Rain: In case of heavy rain, the inflatable should be deflated, and the fan blower must be turned off and covered to avoid water damage.
2.5 Bouncing During Inflation/Deflation: Users must not bounce on the inflatable during the inflation or deflation process, as this can cause damage or injury.
3. Safety Equipment
3.1 Safety Steps: The inflatable’s front safety step is for entry and exit only. It is not for bouncing on or using during play. Users must avoid using the safety step as part of their activity.
3.2 Fan Blower and Power Source: The area around the fan blower must remain clear at all times. The Hirer must ensure that children do not approach or play near the power source to avoid accidents.
4. Cleaning and Damage Liability
4.1 Cleaning Fee: The Hirer agrees to return the inflatable in the same condition as it was delivered. If the equipment is returned dirty, wet, or stained, a cleaning fee of $100 will apply.
4.2 Damage to Equipment: The Hirer is fully responsible for any damage caused by misuse, reckless behavior, or failure to adhere to safety guidelines. Any damages or loss of equipment must be reported to The Bounce House immediately. The Hirer will be liable for the full cost of repair or replacement of the equipment, including associated transport and loss of business costs.
4.3 Risk Acknowledgment: All users of the inflatable do so at their own risk. The Bounce House cannot be held liable for any injuries caused during the hire period.
5. General Safety Conditions
5.1 Segregation of Users: It is recommended to segregate larger children from smaller children to prevent accidents. This is especially important in the case of diverse age groups using the equipment.
5.2 No Sharp Objects: The Hirer must ensure that no sharp objects or toys are brought onto the inflatable, as these can cause punctures and damage.
5.3 Inspection on Delivery: Upon delivery, the Hirer must inspect the equipment and report any visible defects or damage immediately. Failure to do so may result in the Hirer being held responsible for any pre-existing damages.
5.4 Health and Safety Compliance: The Hirer agrees to comply with all safety instructions provided by The Bounce House, including any specific requirements for the installation and operation of the inflatable.
6. Indemnity and Liability
6.1 Indemnity: The Hirer agrees to indemnify and hold The Bounce House harmless from any claims, losses, damages, or liabilities arising from the use of the equipment, including third-party claims for injuries or accidents.
6.2 Waiver of Liability: The Bounce House is not responsible for any injuries caused by misuse or failure to follow safety instructions. The Hirer acknowledges that they are responsible for all users during the hire period.
7. Acknowledgment and Agreement
By signing this Health and Safety Terms and Conditions Agreement, the Hirer acknowledges that they have read, understood, and agree to the outlined safety rules and regulations. The Hirer accepts full responsibility for the safety and condition of the equipment during the rental period and agrees to comply with all health and safety guidelines.
