1. Terms and Conditions of Service

Welcome to The Bounce House! By booking our services, you agree to the following Terms and Conditions, which govern the use of our Equipment, services, and website.

1.1 Booking Process

To book a bouncy castle or inflatable for your event, simply choose your desired Equipment, select the date and time, and proceed with payment. We will confirm your booking via email once payment has been processed. A booking confirmation must be presented on the day of your event for us to deliver the Equipment.

1.2 Services Provided

The Bounce House offers delivery, setup, and takedown of inflatable castles and other entertainment Equipment. Our team will handle the setup and ensure the Equipment is in good condition before use. We ask that you ensure a clear, safe area for setup.

1.3 Payment Terms

Full payment is required at the time of booking unless a deposit option is available for your selected item. Accepted payment methods include credit/debit cards, bank transfer, or cash on delivery. Additional charges may apply for extended hire, extra services (such as delivery outside normal hours), or special requests.

1.4 Customer Obligations

You, the Hirer, are responsible for:

  • Ensuring that the location is suitable for the inflatable (flat, level ground free of obstructions).
  • Providing access for our delivery team on the day of your event.
  • Supervising the Equipment at all times during the hire period to ensure the safety of all users.
  • Informing all guests of the rules and safety guidelines associated with using the inflatable.

1.5 Liability and Indemnity

The Hirer accepts full responsibility for the Equipment during the hire period. You agree to indemnify The Bounce House from any claims, damages, or liabilities resulting from the misuse or reckless use of the Equipment. The Hirer is responsible for any damages or injuries caused by improper use, failure to follow safety instructions, or unauthorized changes to the Equipment.

1.6 Force Majeure

The Bounce House is not responsible for any failure to deliver services or Equipment due to events outside of our control, such as severe weather conditions, natural disasters, government restrictions, or strikes. In these cases, we will attempt to reschedule or offer a full refund if the event cannot proceed.

1.7 Governing Law and Dispute Resolution

This Agreement is governed by the laws of [Insert Jurisdiction]. In the event of a dispute, we encourage you to first reach out to us directly. If the dispute cannot be resolved through communication, it will be handled through binding arbitration or mediation as per the laws of our jurisdiction.


2. Damage Waiver Agreement

To offer peace of mind, The Bounce House provides a Damage Waiver that limits your liability for certain types of damage to our Equipment.

2.1 What’s Covered by the Damage Waiver?

If you choose to purchase the Damage Waiver, it covers minor damage such as small tears, stains, or scuffs caused by normal use. The waiver also covers accidental damage.

2.2 What’s Not Covered?

The following types of damage are excluded:

  • Deliberate Damage: Any intentional or reckless damage caused by the Hirer or guests.
  • Misuse: Damage from improper use, such as allowing more users than the recommended limit or allowing sharp objects on the Equipment.
  • Weather-related Damage: Damage due to wind, rain, or other adverse weather conditions unless otherwise stated in our weather cancellation policy.
  • Cleaning Issues: Excessive dirt, mud, or bodily fluids that cannot be cleaned will incur a cleaning fee. 

2.3 Cost of Damage

In the event of non-covered damage, the Hirer is responsible for the full cost of repairs or replacement. We will assess the damage and provide an estimate for the repair or replacement, which must be paid in full.


3. User Agreement / Rules for Use

To ensure a safe and fun experience for everyone, we ask all users of the Equipment to adhere to the following rules:

3.1 General Safety Rules

  • Only supervised children are allowed on the Equipment.
  • Users must remove shoes before entering the inflatable.
  • No sharp objects, glasses, or toys should be brought onto the Equipment.
  • Food, drinks, or gum are prohibited on the inflatable to avoid messes and potential damage.
  • No rough play such as pushing, shoving, or flipping is allowed.

3.2 Age and Weight Limits

Each inflatable has its own age and weight restrictions. Please refer to the product details for specific limits. Typically, our inflatables are suited for children aged 2–12, but some may have different guidelines based on their size and design.

3.3 Supervision

An adult supervisor must be present at all times while the inflatable is in use. The supervisor is responsible for ensuring that all users follow the rules and ensuring the safety of the children on the Equipment.

3.4 Behavior Expectations

  • No climbing on the walls of the inflatable.
  • No jumping on the entrance or safety steps.
  • Ensure dry faces and hands before use (to avoid slips and stains).

4. Delivery, Setup, and Takedown Agreement

We offer professional delivery, setup, and takedown services for all of our inflatables. Please review the following guidelines:

4.1 Delivery and Setup

Our team will arrive at the scheduled time to set up the Equipment. You must ensure that the setup area is clear of debris, sharp objects, and any obstacles. We require a flat, level area with access to a power source (if required) for the blower.

4.2 Access Requirements

Please ensure that there is clear access to the delivery location. If we need to navigate stairs, narrow pathways, or obstacles, please inform us beforehand so we can ensure proper delivery.

4.3 Takedown

Once your event has ended, our team will return to safely take down the inflatable. Please ensure the area is clear and that no items are left on the Equipment.


5. Refund Policy

We strive to ensure that your event goes smoothly. However, we understand that things can change. Here’s our refund policy:

5.1 Full Refunds

You are entitled to a full refund if you cancel your booking at least 7 days before the event.

5.2 Partial Refunds

For cancellations made less than 7 days but more than 48 hours before the event, you will receive a 50% refund of your total booking amount.

5.3 No Refunds

For cancellations within 48 hours of the event, no refund will be given. This is due to the short notice, which impacts our scheduling and equipment availability.

5.4 Weather Cancellations

If adverse weather conditions (rain, high winds, etc.) prevent us from setting up or using the Equipment, we will offer you a full refund or the option to reschedule your booking. Cancellations due to weather will be determined by our team based on real-time forecasts.


6. Event Liability Disclaimer

We take safety seriously, but accidents can happen. By booking with us, you acknowledge the following:

6.1 Assumption of Risk

All individuals using the Equipment do so at their own risk. The Bounce House is not liable for any injuries, accidents, or damages that occur during use.

6.2 Parental Supervision

Parents and guardians are responsible for ensuring the safety of children on the Equipment. Children must be supervised at all times.

6.3 Indemnity

The Hirer agrees to indemnify The Bounce House against any claims, actions, or damages resulting from the use of the Equipment, including but not limited to personal injury, property damage, or third-party claims.


7. Social Media and Photography Policy

We love to see our customers enjoying their events! By booking with us, you agree to the following:

7.1 Photography and Video

We may capture photos or videos during your event for promotional purposes. If you do not wish to have your event featured on our social media or website, please let us know prior to the event.

Your safety is our priority, so please read the following terms carefully. We’ve experienced a few issues with the Equipment not being treated properly, so we’ve included guidelines to help prevent any damage or charges. By signing this agreement, you acknowledge and agree to the terms outlined below.

This Hire Agreement (the "Agreement") outlines the terms and conditions for the hire of the inflatable bouncy castle (the "Equipment") from The Bounce House (the "Company") by the person or entity hiring the Equipment (the "Hirer"). By hiring the Equipment, the Hirer agrees to abide by these terms.


1. Safety Responsibilities

1.1 The Hirer understands that safety is of utmost importance. It is the Hirer’s responsibility to take all necessary precautions to prevent injury or damage to the inflatable during the hire period.

1.2 Supervision: An adult over 18 years of age must supervise the Equipment at all times during use.

1.3 Running Near the Fan: It is strictly prohibited to run near the fan blower or power source.

1.4 Segregation of Users: It is recommended to separate larger children from smaller ones unless they are assisting.

1.5 Behavior: Pushing, colliding, fighting, or any behavior that could cause injury or distress is strictly prohibited.

1.6 Items to Avoid: Keep items such as streamers, poppers, silly string, face paint, and any substances that could stain the PVC or vinyl away from the inflatable.

1.7 Face and Hands: Ensure that children’s faces are dry and free from face paint before using the Equipment.

1.8 Overcrowding: Please adhere to the maximum number of users specified for each inflatable on our website. Overcrowding is dangerous and can lead to damage or injury.

1.9 Safety Step: Do not allow children to bounce on the front safety step, as it could result in injury. The safety step is only for entry and exit from the Equipment.


2. Restrictions

2.1 No Pets or Sharp Objects: Pets, sharp instruments, or toys are not allowed on the Equipment.

2.2 Eating and Drinking: No eating, drinking, or chewing gum is permitted while using the Equipment.

2.3 No Smoking or BBQ: Smoking or BBQ activities near the Equipment are strictly prohibited.

2.4 Health Conditions: Individuals with back or neck issues should not use the Equipment.

2.5 Bouncing During Inflation/Deflation: Bouncing on the Equipment during inflation or deflation is prohibited.

2.6 Clear Space: Maintain at least 1 meter of clear space around the Equipment for safety.

2.7 Climbing and Hanging: Climbing, hanging, or sitting on the walls of the inflatable is dangerous and not allowed.

2.8 Fan Blower Use:

  • Rain: In case of heavy rain, the fan blower must be turned off and disconnected. Protect the blower from rain to prevent damage, and dry any wet surfaces with a towel once the inflatable is inflated again.
  • Wind: If wind speeds exceed 30 km/h, the Equipment must be deflated immediately and should not be used.

2.9 Moving Equipment: Do not attempt to move the Equipment after it has been set up. Moving it may cause damage or injury.

2.10 Water Use: Most of our castles are designed for dry use. Water should only be used with specific castles like the Wipe Out and Rainbow Slidemodels. Water should not be used on other inflatables.


3. Cleaning and Damage Liability

3.1 Cleaning Charges: If the Equipment is returned wet, muddy, or stained, a cleaning fee of $100 may apply.

3.2 Inspection on Delivery: The Hirer is responsible for inspecting the Equipment upon delivery. Any existing damages or issues should be reported to The Bounce House immediately. Failure to report any pre-existing damage may result in the Hirer being held responsible for the full repair costs. This includes repair, transportation, and loss of business costs due to Equipment downtime.

3.3 Damage and Liability: The Hirer accepts full responsibility for any damage caused to the Equipment due to misuse or reckless behavior.

3.4 Risk Acknowledgment: All individuals using the Equipment do so at their own risk.

3.5 Company Liability: The Company cannot be held liable for any injury caused while using the Equipment.


By hiring with us you are agreeing to the Hire Agreement, the Hirer agrees to adhere to these terms and ensures that all individuals using the Equipment follow the safety and usage guidelines. PHOTO BACKDROP HIRE – TERMS & CONDITIONS

Effective for all hires through The Bounce House NZ

By booking a photo backdrop with The Bounce House NZ, you agree to the following terms and conditions:

HIRE DETAILS:

  • Our photo backdrops are double-sided, 2 metres wide, and come with a round circle stand for easy setup.

  • Backdrops are pick-up only from our designated address. It is the customer’s responsibility to transport, assemble, disassemble, and return the backdrop safely.

  • Hire is for one-day use only, with the item to be returned the following day, unless otherwise agreed.

DAMAGE, LOSS & CLEANING:

  • All backdrop items must be returned in the same condition they were collected.

  • If any part of the backdrop or stand is damaged, lost, stained, marked, torn, or broken, the customer will be charged the full RRP replacement cost of the affected item(s), along with any applicable shipping or admin fees.

  • Examples of damage include (but are not limited to): rips, large creases, permanent stains, water damage, frame damage, missing pieces, adhesive or tape residue, or paint/glitter/pen on surfaces.

  • If the item is returned requiring excessive cleaning or repair, a cleaning fee will apply at our discretion.

SETUP & SAFE USE:

  • Backdrops are designed to sit flush against a wall or fence and should be set up on flat, stable ground.

  • They are not suitable for outdoor use in rain, strong wind, or on uneven surfaces.

  • Children must be supervised around the backdrop at all times – the stand is not a toy, and climbing or pulling on it can cause injury or damage.

  • Customers must not alter, tape, glue, or pin anything directly to the backdrop surfaces.

LATE RETURNS:

  • Backdrops must be returned the day after hire, unless otherwise arranged.

  • Late returns will incur a $20 late fee per day.

  • After 3 days, the item will be considered non-returned, and the customer will be invoiced the full replacement value.

LIABILITY:

  • The Bounce House NZ is not responsible for any injuries, accidents, or property damage caused by misuse or improper setup of the backdrop and stand.

  • By hiring, the customer agrees to take full responsibility for the safe handling, use, and return of all items.
